Washoe County barrier requirements

Washoe County's residential pool handout sets these barrier rules (based on the International Swimming Pool and Spa Code):

  • Top of the barrier at least 48 inches above grade, measured on the side away from the pool.
  • No more than 2 inches between grade and the bottom of the barrier, measured on the side away from the pool.
  • Openings between vertical members limited (the handout cites 1.75 inches for the barrier type it describes), so a child cannot squeeze through or climb.
  • Pedestrian gates open outward, away from the pool, and are self-closing and self-latching.
  • The latch release sits on the pool side at least 3 inches below the top of the gate, or at 54 inches above the ground.

Pool barriers always require a permit in Washoe County, whatever their height, and the barrier must be installed, inspected and approved before gunite is applied or the pool is filled with water.

Using the yard fence as the barrier

Some homeowners use the perimeter backyard fence as the pool barrier. That works only if every section and every gate meets the barrier rules, including gates neighbors use and the side-yard gate the utility reader opens. Doors from the house into the pool area raise their own requirements in the pool code. A dedicated fence around the pool deck is often simpler to inspect.

Spas and above-ground pools

Barrier rules are written for swimming pools and spas generally, not only in-ground pools. How they apply to an above-ground pool or a hot tub on a patio is the building department's call, so ask before you buy a fence kit or a cover.
