Old Dayton and new Dayton

Dayton sits at a bend in the Carson River at the western end of the Twenty-Six Mile Desert. Emigrants once stopped here to decide which way to go, giving it the name Ponderers Rest; gold found in Gold Creek in 1849 brought placer miners to Gold Cañon, and in 1861 the town took the name of surveyor John Day. It was the Lyon County seat until 1911, survived Great Fires in 1866 and 1870, and appeared in John Huston's 1961 film The Misfits. Growth since the 1990s has spread on the east side of the river, and the 2020 census counted 15,153 residents.

Historic district review

The historic part of Dayton is within the Comstock Historic District, along with Virginia City and Gold Hill. The Comstock Historic District Commission, a state agency under the State Historic Preservation Office, issues Certificates of Appropriateness for work that includes fencing, retaining walls and pavement. Building a fence there before getting a certificate can draw a stop-work order. If you are in old Dayton, start with the Commission, then the county.

Lyon County fence rules

For unincorporated Lyon County, the county's guidance is that fences of 6 feet or less do not need a building permit, with a 6-foot maximum on side and rear yards, 4 feet in front yards and 2 feet within 25 feet of an intersection. Applications go to the Yerington office or, in some cases, the Dayton office.

Lots near the Carson River can sit in mapped floodplain. Open fences such as split rail pass water and debris better than solid ones; check the flood map before building across a low area.

Desert conditions

East of the Carson Range, Dayton is open to wind and sun. Solid privacy fences need close post spacing and deep footings, and wood needs a sealer renewed on a schedule. On acreage, chain link, wire and rail cover distance at a lower cost per foot.
